1. Eligibility

You hereby represent and warrant that you have the right, power, and legal capacity to enter into these Terms, to become a party to a legally binding agreement, and to perform all your obligations hereunder.

2. Definitions

• “Payment Instrument” includes credit cards, debit cards, net banking, UPI (Unified Payment Interface), digital wallets, or any other payment method deployed by banks and financial institutions on the Platform.
• “Platform” refers to the website (knduct.in) and mobile application/services operated by KNDUCT where events, tickets, and passes are listed and transactions are initiated.
• “Transaction” refers to the order or ticket pass booking request placed by the User on the Platform to purchase event passes or services listed by paying the Transaction Amount.
• “Transaction Amount” means the total amount paid by the User in connection with a Transaction, including ticket pricing, platform service fees, and applicable statutory taxes.
• “User / Users” means any individual or entity availing products, tickets, or services offered on the Platform.

3. Merchant's Rights

You agree that we may collect, store, process, and share the information provided by you in order to deliver ticket passes, issue cryptographic QR entry passes, generate tax invoices, process refunds, and contact you in relation to your transactions or account.

4. Your Responsibilities

You agree to provide us with true, complete, and up-to-date information about yourself as required for completing Transactions. This includes but is not limited to personal details such as your full name, email address, phone number, city, age, and valid payment information required for ticket processing.

5. Prohibited Actions

As a User of the Platform, you explicitly agree not to engage in any of the following prohibited activities:

• Systematically retrieving data or content from the Platform to create collections, databases, or directories without prior written permission from us.
• Making unauthorized use of the Platform, including collecting usernames, email addresses, or phone numbers for unsolicited communications.
• Circumventing, disabling, or interfering with security-related features of the Platform, including ticket HMAC signature checks, QR code hash verification, or rate limits.
• Tricking, defrauding, or misleading us or other users to obtain sensitive account credentials or OTP verification codes.
• Engaging in automated script execution, bot usage, ticket hoarding, or data mining/scraping tools.
• Interfering with, disrupting, or creating an undue burden on the Platform, servers, or connected networks.
• Attempting to impersonate another user, event organizer, or platform administrator.
• Reverse engineering, decompiling, disassembling, or copying any of the platform code (HTML, JavaScript, React components, backend APIs).
• Uploading viruses, malware, Trojan horses, or engaging in continuous repetitive text posting (spamming).
• Using the Platform in a manner inconsistent with any applicable local, state, or national laws and regulations.

6. Limitation of Liability & Indemnification

The User agrees that their sole recourse in the event of receiving a deficient service, event cancellation, or product discrepancy is to initiate the refund process subject to the terms of our Refund Policy.

The User shall indemnify and hold harmless KNDUCT, Pigeon Labs, and its affiliates, officers, agents, and representatives from and against any and all claims, liabilities, losses, damages, injuries, costs, and legal expenses arising out of any breach of these Terms by the User.

7. Guidelines for Reviews & User Feedback

When posting reviews, event ratings, or comments on the Platform, you must comply with the following criteria:

• You should have firsthand experience with the event or venue being reviewed.
• Your reviews must not contain profanity, hate speech, abusive language, or discriminatory references based on religion, race, gender, age, or disability.
• Your reviews must not contain references to illegal activity or false/misleading statements.
• We reserve the right to accept, reject, or remove reviews at our sole discretion.

8. Governing Laws & Dispute Resolution

These Terms, their subject matter, and formation are governed by the laws of India. You and KNDUCT agree that the courts in India shall have exclusive jurisdiction over any dispute.

Any dispute or claim arising out of or relating to these Terms shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be in India and proceedings shall be conducted in English.

Upon initiating a Transaction, you enter into a legally binding contract to purchase event passes/services, and agree to pay through legal sources of funds and accepted Payment Instruments.

All payment attempts are undertaken at your own risk. KNDUCT shall not be liable for losses resulting from payment gateway authorization decline, network timeouts, or banking malfunctions.

You are responsible for keeping your login credentials and OTP codes confidential and configuring your devices with up-to-date security measures.
